Telestream Communications (PTY) LTD trading as Hello Mobile with registration number 2005/000647/07 located at Hello House centurion gate business building 12, 124 Akkerboom street centurion, Gauteng, 0157 (hereinafter referred to as “Hello Mobile”, “Assignee” and “Our”) will be giving away 1 of 100 Hello Mobile sim cards plus 2 Giga bytes (hereinafter referred to as the “Competition Prize”) to the winner of the Hot Deal competition. By entering this competition each Participant agrees to comply with these Hello Mobile: Hot Deal Terms and Conditions (herein referred to as “T&C’s”).
The Hot Deal competition entry period will run from the 1st of December 2023 to the 31st of January 2024.
2.1. A person entering the Hot Deal competition will be considered a Participant if:
2.1.1. The person has entered the Hot Deal competition in accordance with clause 4;
2.1.2. The person is a South African natural person and at least 18 years;
2.1.3. The person is a South African resident;
2.1.4. The person has read and agreed to these T&C’s; and
2.1.5. It must be lawful for the person to receive the Competition Prize.
3.1. If you are an employee, agent, or consultant of Hello Mobile or affiliated companies; and
3.2. If you do not meet the qualifying criteria detailed above in clause 2.
4.1. STEP 1: Take a selfie using the Our Hot Deal filter;
4.1.1. STEP 2: Add the tag @hellomobileSouthAfrica to your selfie;
4.1.2. STEP 3: Post the selfie on your Instagram and/or Facebook profile; and
4.2. Step 4: Follow the @hellomobileSouthAfrica Instagram and/or Facebook profile.
4.3. After the completion of all steps the Participants entry will be referred to as the Post.
4.4. Multiple entries are allowed if the entry complies with these T&C’s.
5.1. Any foul language, defamation, hate speech;
5.2. inappropriate content; and
5.3. Any Post which is harmful or infringes the intellectual property rights of Hello Mobile, any of Hello Mobile associated companies or any third-parties will be deemed inappropriate at Our sole discretion.
6.1. The Participant:
6.1.1. hereby warrants that he or she is the creator of the Post;
6.1.2. hereby indemnifies and holds harmless Hello Mobile from the Participants failure to comply with the abovementioned warranty contained in sub-clause 6.1.1.
6.2. Hello Mobile reserves the right to remove any Post contravening the provisions of these T&C’s.
7.1. Hello Mobile will select the winners of the Hot Deal competition from the 1st of December 2023 to the 31st of January 2024 (hereinafter referred to as the “Selection Period”).
7.2. The winner will be contacted by Hello Mobile during the Selection Period mentioned in clause 7.1
7.3. The winner will be required to accept the Competition Prize within 5 days of being notified by Hello Mobile thereof. If the winner fails to notify Hello Mobile of his or her acceptance of the Competition Prize, the winner waives any rights he or she may have against Hello Mobile.
7.4. After the winner has accepted the Competition Prize, in accordance with these T&C’s, the winner must complete the relevant documents and provide Hello Mobile with the relevant details to receive the Competition Prize.
7.5. After the winner has been selected the decision of Hello Mobile is full and final.
8.1. By entering the Hot Deal competition each Participant (herein referred to “Assignor”) assigns, transfers, and makes over to the Assignee all rights, title, and interest in the Post, including without limitation, the copyright, the Assignors common law copyrights and all other intellectual property rights associated and subsisting in the Participants Post, indefinitely and worldwide.
8.2. The Assignor agrees to do all such things necessary, as may be reasonably required, to perfect, protect or enforce any of the rights assigned, transferred, and/or made over to the Assignee.
8.3. The Assignee will be the exclusive owner of the Post and of any copyright in the Post as from the date of the Assignor entering the Hot Deal competition.
8.4. The Assignor shall not retain any rights in the Post and irrevocably and unconditionally waives, in favour of the Assignee, any moral rights which the Assignor may have.
8.5. The Assignor shall, if requested by the Assignee to do so, provide all reasonable information, materials, co-operation, and/or assistance to the Assignee to enable the Assignee to prove the subsistence of the Assignees rights, title, or interest in the Post before any court or relevant forum.
The winner may be disqualified if he or she fails to comply with the provisions of these T&C’s.
By participating in the Hot Deal competition, the Participant consents to the use, by Hello Mobile or authorised third-party, of any information the Participant makes available to Hello Mobile. This information includes but is not limited the Post, image, photograph, and video of the winner which may be used as Hello Mobiles’ marketing material.
Hello Mobile reserves the right to cancel this Hot Deal competition, change the prize or amend these T&C’s.
